McLaren taking legal action against Red Bull for violating a Legally Bound Contract.

McLaren has launched a legal battle against Red Bull.

Couple months ago, it was announced that Red Bull's Aerodynamics Chief, Peter Prodromou and his Deputy Dan Fallows would be working for McLaren this year. The contract was completed and he was legally bound to work for McLaren.

However recently, Fallows has signed another contract to be the Head of Aerodynamics at Red Bull, despite already in a Legally Binding contract to work for McLaren.

It has came apparent that Fallows was made to stay at Red Bull by offerng him the departing Prodromou's job and salary, despite already signing the contract to work at Woking.

“The matter is now in the hands of our lawyers,” team boss Eric Boullier said in a teleconference on Wednesday.
Meanwhile, ahead of his new McLaren role, Red Bull said Prodromou has now left the team to start “a period of gardening leave” (sometimes dubbed as a "No-Compete Clause").

How can they sue Red Bull? Surely it's the PERSON (Dan Fallows) that has breached contract by not fulfilling his contact.

Red Bull issued the contract which they signed, knowing full well that he was already signed with McLaren. Red Bull are forcing the issue, so McLaren had no choice but to take legal action.

It's incresaingly difficult to enforce any type of contract, not just in F1 but in a business sense. There will be several get out clauses, which could even include an individual changing their mind.

Would you want someone on your team who would rather be somewhere else? How much effort are they going to give? They are probably going to do more harm than good. If it was that easy to change their mind they cannot have wanted the job much.
